Background
The Fair Labor Standards Administration
(FLSA) requires that most employees in the United
States be paid at least the Federal minimum wage
and overtime pay at time and one-half the regular
rate of pay after 40 hours in a workweek. In addition,
the law includes child labor and record keeping
provisions. However, the Act provides some specific
exemptions from these requirements for employees
employed by certain establishments and in certain
occupations.
Some State wage laws may not recognize or permit
the application of this exemption, and since an
employer must comply with the most stringent of
the State or Federal provisions, it is strongly
recommended that the State laws be reviewed prior
to applying this exemption.
